2.2 Contracts – A signed agreement between A.C. Earthworks and the Client will outline the final scope of work, project timelines, and payment terms.

3. CLIENT OBLIGATIONS

3.1 Site Access & Conditions – The Client is responsible for providing clear access to the worksite and disclosing any known hazards, restrictions, or underground utilities.

3.2 Permits & Compliance – Unless otherwise agreed, the Client is responsible for obtaining all necessary permits, approvals, and regulatory compliance for the project.

3.3 Project Modifications – Any requested changes to the agreed scope of work must be submitted in writing and may be subject to additional costs and extended timelines.

4. PAYMENT TERMS

4.1 Deposit & Invoices – A deposit may be required before work commences. All invoices must be paid in accordance with the agreed payment schedule outlined in the contract.

4.2 Late Payments – Payments not received by the due date may incur late fees, interest charges, or suspension of work until payment is made.

4.3 Refunds & Cancellations – Deposits are generally non-refundable. Cancellations after work has commenced may be subject to fees covering labor, materials, and administrative costs.

5. PROJECT TIMELINES & DELAYS

5.1 Estimated Completion – While we make every effort to adhere to project schedules, unforeseen circumstances such as weather conditions, equipment failure, or third-party delays may impact completion times.

5.2 Force Majeure – A.C. Earthworks is not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, labor disputes, government actions, or supply chain disruptions.

6. WARRANTIES & LIABILITY

6.1 Workmanship Guarantee – A.C. Earthworks warrants that all services will be performed in a professional manner, consistent with industry standards.

6.2 Limited Liability – We shall not be liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability is strictly limited to the cost of the contracted service.

6.3 Damage & Indemnification – The Client agrees to indemnify and hold harmless A.C. Earthworks from any claims, damages, or liabilities arising from site conditions, third-party actions, or unforeseen underground obstructions.
